If you are seeking to transfer title of your property to your spouse or to add your spouse’s name to title, we can assist you. These types of transfers can occur for a variety of reasons, such as marriage, separation, or other arrangement. Regardless of the circumstances surrounding your need to transfer title, we are here to help.
Our real estate team also regularly assists clients with interfamily transfers. The two most common interfamily transfers are cottage generational transfers and estate planning transfers such as adding an adult child to title. Whether the transfer constitutes a gift or forms part of your estate planning considerations, we will safeguard your legal interests and provide you with all the relevant factors so that you can make a confident and informed decision.
If a property owner is deceased but still registered as an owner on title, we can assist you. Upon an individual’s death, their name is not automatically removed from title to real property that they owned as joint tenants with another person. Should the surviving joint owner of this property wish to deal with the property in the future (i.e. re-mortgage or sell the property), they will need to correct the title by registering a Survivorship Application. Our real estate lawyers will guide you through this process and attend to the preparation, signing, and registration of this Application.
If real property forms part of a deceased individual’s Estate, our real estate team will facilitate the transfer of title to the Estate Trustee(s). We will then assist the Trustee with a transfer of title to a beneficiary, or with the sale of the property during the estate administration process. We understand that administering an estate can be a complex and convoluted process during an already difficult time. We can assist and help you navigate these complexities and deal with any estate-owned properties.
